Are you ready?

The Single-Use Plastic Directive (SUP) outlines mandatory actions for entrepreneurs in the food service sector. These include, among others, recording packaging and the obligation to charge customers for it. This information must be submitted in accordance with the procedures of the BDO system. What does this mean for you?

obligation

Since July 1, 2024, food service businesses are required to provide alternative packaging for single-use plastic products. This obligation arises from the Act of May 11, 2001, on Entrepreneurs' Obligations in Waste Management and the Product Fee, Article 3b, Section 3.

Do you run a food service business and use packaging? Remember to:

Obtain an entry in the BDO register (Section II, Table 8).

Collect the fees:

  • PLN 0.20 – for drink cups,
  • PLN 0.25 – for food containers.

03

Keep records of:

  • the quantity of purchased and distributed single-use plastic packaging,
  • the fees collected from customers.

04

Submit the annual report to BDO.

Entrepreneurs must keep information about packaging and collected fees for 5 years.

Plastic bags
in the food service sector

Every owner of a food service establishment is required to charge a recycling fee for plastic bags provided to customers. This obligation arises from Article 40a of the Act of June 13, 2013, on Packaging and Packaging Waste Management.

If you run a food service business and use packaging, remember to:

Register in the BDO system;

Charge a fee of 0.20 PLN for each bag;

03

Keep records of the number of purchased and distributed shopping bags of specific thickness:

  • below 15 micrometers,
  • below 50 micrometers,
  • above 50 micrometers;

04

Submit the annual report to BDO with information about the plastic shopping bags provided to customers.

Failure to pay the recycling fee may result in a fine ranging from 500 to 20,000 PLN.

In accordance with the Act of June 13, 2013, on Packaging and Packaging Waste Management, any establishment offering takeaway or delivery meals is required to submit an annual report on the packaging placed on the market and register in the BDO database. Please review the Terms of Service of the Online Platform , the Terms of the Integrator System , and the Privacy Policy, which apply to the services provided. Additionally, familiarize yourself with the Commercial Information regarding the services available in the Integrator System, as well as the rules for selecting the services displayed therein. The Commercial Information includes the Special Terms for the service "Food service in BDO." In the event of an expansion of the services available in the Integrator System, the Commercial Information will include details about each service and the rules for selecting the displayed services. This service information does not constitute an offer within the meaning of the provisions of the Civil Code, particularly Articles 66 and 66(1) of the Civil Code.

Enter the weights of the packaging, and based on this information, we will calculate an estimated service value and present you with our most advantageous proposal. The estimated value is a non-binding calculation, as the final remuneration of the entity will be determined according to the terms of the proposed agreement.

What do the regulations say?

If you operate a food service, retail, or wholesale unit and offer single-use plastic packaging or sell food or beverages packaged in such packaging (including from vending machines), you are required to charge the end consumer a fee for single-use plastic containers and cups. This obligation is in accordance with the Regulation of the Minister of Climate and Environment, dated December 7, 2023, on the fee rates for single-use plastic products classified as packaging.
